Terms and Conditions
Important: This service provides preliminary AI-assisted research only. It is not an appraisal, inspection, legal opinion, title report, survey, engineering report, financial advice, or guarantee.
1. Agreement
By creating an account or using Property Intelligence AI (the “Service”), you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter this agreement.
2. Preliminary information only
AI and online sources can be incomplete, outdated, inaccurate, unavailable, or misinterpreted. Outputs may contain errors. The Service does not determine market value, property condition, ownership, insurability, legality, zoning, permitting, boundaries, hazards, financing eligibility, or suitability for any purpose.
3. Your responsibility
You are solely responsible for your decisions and for independently verifying all material information. Before purchasing, selling, leasing, financing, improving, or relying on a property, consult appropriately licensed professionals and authoritative agencies.
4. No professional or fiduciary relationship
Use of the Service does not create an agent-client, broker-client, attorney-client, inspector-client, fiduciary, advisory, or other professional relationship. A separate signed agreement is required for any professional service offered by Tony El Fata or an affiliated business.
5. User information and acceptable use
You must provide accurate account information, protect your credentials, and have the right to submit all content you provide. Do not submit another person’s confidential information without authority. You may not misuse the Service, probe its security, automate excessive requests, introduce malicious code, impersonate others, or use outputs for unlawful discrimination, fraud, harassment, or decisions governed by consumer-reporting laws.
6. Third-party information and AI
The Service may use OpenAI and public websites. We do not control or endorse third-party sources and do not guarantee their availability or accuracy. Source links are provided for investigation, not certification. Property prompts and supplied property details may be transmitted to AI service providers to generate responses.
7. Intellectual property
The Service design, branding, prompts, and software are protected by applicable law. You may use reports generated for personal or internal business purposes, subject to third-party rights and these Terms. You may not resell, scrape, reverse engineer, or falsely represent the Service or its output.
8. Availability and changes
We may modify, suspend, restrict, or discontinue any part of the Service, impose reasonable usage limits, or update these Terms. We do not promise uninterrupted or error-free operation.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, or results. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
10. Limitation of liability
To the fullest extent permitted by law, Tony El Fata and the Service’s owners, affiliates, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or opportunities; property or transaction loss; or decisions made from Service outputs. Aggregate liability arising from the Service will not exceed the greater of the amount you paid during the 12 months before the claim or US $100. These limits do not apply where prohibited by law and do not exclude liability that cannot legally be limited.
11. Indemnity
To the extent permitted by law, you agree to defend and indemnify the Service and its owners against third-party claims arising from your unlawful use, submitted content, violation of these Terms, or infringement of another person’s rights.
12. Governing law
These Terms are governed by the laws of the State of Hawaiʻi. Subject to applicable law, disputes will be brought in state or federal courts serving Hawaiʻi County, Hawaiʻi.
